THE MAGIC BEACH HOUSE RULES 2008:

The contest starts on Tuesday, May 27, 2008 at 7am and runs through August 1, 2008 at 7:40pm with the final MAGIC BEACH HOUSE awarded on August 4, 2008. All qualifiers must be identified by 7:40pm on August 1 in order to be eligible to win the Grand Prize. Excludes Friday, July 4, 2008 (Holiday). You must be at least 21 years old and a resident of Massachusetts, Rhode Island, New Hampshire or Maine in order to be eligible to qualify.

To Enter:

All members of the MAGIC WORKFORCE who are 21 or over are automatically entered in the MAGIC BEACH HOUSE contest. Eligible contestants may join the MAGIC WORKFORCE by going to www.magic1067.com and registering on-line. There is no charge to register. Eligible contestants also may register by faxing to (617) 822-6559, or mailing their name, address, telephone number, and age to 55 Morrissey Boulevard, Boston, MA 02125 ATTN: The MAGIC BEACH HOUSE. One name from the MAGIC WORKFORCE will be announced each weekday in the following hours: 7am, 10am, 2pm and 7pm (excluding the Holiday). The person whose name is announced will have 30 minutes to call 617-931-1067 upon hearing their name. Eligible qualifiers will be awarded a MAGIC Beach Bag and be qualified for a chance to win a week at the MAGIC BEACH HOUSE in all subsequent drawings during this contest. The person who calls back to qualify must be actual person whose name was announced; no substitutes. Void where prohibited. All entries become the property of MAGIC 106.7. Only one entry per person and one winner per household.

Online listeners to the MAGIC web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in this contest.

Winner qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call. Contest calls will not be accepted at any other number.

Prize; Drawing:

Qualifying Prize (up to 200 qualifying prizes will be awarded): MAGIC Beach Bag, ARV $1,550.

Grand Prize is a 7-night stay at the MAGIC BEACH HOUSE in Hyannis, MA. Ten (10) MAGIC BEACH HOUSE stays will be awarded. One winner will be selected each week during the contest from all qualifiers to date. Winners will be notified by phone, mail and/or email. The dates for the MAGIC BEACH HOUSE are as follows:

Dates are fixed and cannot be extended or changed by winner. MAGIC 106.7 reserves the right, if needed, to alter dates to meet requirements as set by sponsors. Maximum capacity of the MAGIC BEACH HOUSE is 4 people. Transportation, meals, and other incidental expenses are not included in prize. No animals, birds, or pets of any description shall be kept in or upon the leased premises. Winner must bring their own bed linens, towels, extra blankets, and fireplace wood, and must comply with all house rules as communicated by the landlord. Landlord reserves the right to eject any house guests for violation of house rules or applicable laws or ordinances. Check-in time is 2:30 PM on the designated Saturday and check-out is 10:30 AM on the following Saturday. Winner will be responsible for a security deposit in the amount of $500 (payable via personal or bank check) and also for any additional damages incurred, if any. Odds of winning the MAGIC BEACH HOUSE depend on the number of eligible entries received. Approximate retail value of prize is $1,550.

Winners must sign a release which provides MAGIC 106.7 with the right to publicize and/or broadcast the name, likeness, and voice of each winner in connection with the award of the prize in this contest, and which releases MAGIC 106.7 and Greater Boston Radio, Inc. and their advertisers, sponsors, employees and affiliates from any liability for injuries or damages of any kind sustained as a result of winner’s participation in the contest and/or accepting the prize. Winners will be required to come to MAGIC 106.7 between 8:30am to 5:30pm, Monday through Friday, to sign the necessary paperwork to obtain their prize. Winners must claim their prizes within five (5) days after being notified by Magic 106.7; prizes not claimed within the 5-day period will be forfeited and a new winner selected.

All prizes are non-transferable. Prizes may not be substituted or redeemed for cash. Odds of winning depend on number of eligible entries received, and number of eligible qualifiers in each week’s drawing.

Eligibility

All entrants must be at least 21 years old, legal residents of the United States, and a resident of Massachusetts, Rhode Island, New Hampshire or Maine. A winner will be disqualified and any prize awarded will be forfeited if he/she or a member of his/her household has won a MAGIC 106.7 prize with a value over $25.00 within the previous 30 days, or a prize valued at $1,000.00 or more within the previous year. Employees (including their immediate families and members of the same household) of Greater Boston Radio, Inc., its affiliates (including MAGIC 106.7), promotional sponsors, and advertising and promotional agencies who do business with MAGIC are not eligible to participate in any contest presented by MAGIC 106.7. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” One entry per person; multiple entries will disqualify the entrant. No purchase or other consideration is necessary to participate in a contest.

GENERAL:

MAGIC 106.7 undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). Magic 106.7 is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station. MAGIC 106.7 is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest.

Winners are responsible for any and all applicable taxes associated with claiming prize(s). 1099 form will be provided to all winners and filed with the IRS. Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of the contestant, will result in the contestant’s disqualification and forfeiture of any prize won. MAGIC 106.7 reserves the right to make changes in the contest rules at any time, which changes will become effective upon announcement. By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of MAGIC 106.7 and whose decisions with respect to all aspects of the contest are final and binding.
